Terms of Service – Forklift Rental – Connecticut

1. General Provisions

1.1 Definitions

  • „Lessor” – the owner of the forklift rental service

  • „Lessee” – the individual or legal entity renting the forklift

  • „Equipment” – the forklift being rented

  • „Service” – the website for rental reservations

1.2 Business Purpose
The Lessor operates a forklift rental business in the state of Connecticut in accordance with applicable federal and state regulations.

2.1 Business Registration
The Lessor is registered with the Connecticut Department of Revenue Services in accordance with Connecticut General Statutes.

2.2 Rental Surcharge
In accordance with Connecticut General Statutes §12-692, rentals of forklifts for periods up to 365 days are subject to a rental surcharge of 1.5% of the rental amount.

2.3 Sales Tax
Equipment rentals are subject to Connecticut Sales Tax at a rate of 6% plus any applicable local taxes.

3. Operator Requirements

3.1 Operator Certification
In accordance with OSHA 29 CFR 1910.178, every forklift operator must possess valid OSHA certification. The Lessee agrees to use the equipment only through certified operators.

3.2 Age Restrictions
According to federal law, persons under 18 years of age may not operate forklifts.

3.3 License Requirements
If the rental includes equipment with a lifting capacity exceeding 5 tons with a maximum reach over 32 feet, used in construction projects valued over $1,250,000, the operator must possess a Connecticut Hoisting Equipment Operator License.

4. Insurance and Liability

4.1 Lessee Insurance Requirements
The Lessee is required to maintain throughout the rental period:

  • General Liability insurance with a minimum limit of $1,000,000 per occurrence

  • Workers’ Compensation insurance in accordance with Connecticut requirements

4.2 Lessee Liability
The Lessee assumes full responsibility for:

  • Damages resulting from equipment use

  • Third-party injuries

  • Property damage

  • Improper use of equipment

5. Reservation Process

5.1 Making Reservations
Reservations are made through the website form. Reservations are not binding until accepted by the Lessor.

5.2 Reservation Confirmation
The Lessor reserves the right to refuse rental without providing a reason. Confirmation occurs through email or telephone contact.

6. Payment Terms

6.1 Payment Methods
Payments are processed outside the internet platform through:

  • Bank transfer

  • Credit card payment

6.2 Price Structure
According to the price list:

  • Daily rental: $120/day

  • Weekly rental: $720/week

  • Monthly rental: $2,790/month

  • Additional one-time delivery fee (up to 10 miles): $400

7. Personal Data Protection

7.1 CTDPA Compliance
The Lessor complies with the Connecticut Personal Data Privacy and Online Monitoring Act (CTDPA) regarding personal data processing.

7.2 Consumer Rights
Customers have the right to:

  • Access their data

  • Correct data

  • Delete data

  • Restrict processing

8. Website Accessibility

8.1 Accessibility Requirements
The website meets the requirements of the Connecticut Universal Website Accessibility Policy, in accordance with WCAG 2.1 Level A.

9. Consumer Protection

9.1 Connecticut Consumer Protection Laws Compliance
The Lessor complies with the Connecticut Unfair Trade Practices Act and other consumer protection regulations.

9.2 Complaint Procedures
Customers may file complaints with the Connecticut Department of Consumer Protection in accordance with Connecticut General Statutes Title 21a.

10. Rental Terms

10.1 Pre-Rental Inspection
Equipment is subject to inspection before each rental. The Lessee is required to report any damage before use.

10.2 Damage Liability
The Lessee bears full financial responsibility for equipment damage occurring during the rental period.

10.3 Equipment Return
Equipment must be returned in undiminished condition, accounting for normal wear and tear.

11. Dispute Resolution

11.1 Governing Law
These Terms are governed by Connecticut state law. Disputes are resolved by Connecticut courts.

11.2 Mediation
The parties agree to attempt dispute resolution through mediation before filing a lawsuit.

12. Final Provisions

12.1 Terms Modifications
The Lessor reserves the right to modify these Terms. Changes take effect upon publication on the website.

12.2 Severability
If any provision of these Terms is deemed invalid, the remaining provisions remain in effect.
